  • raising investments with a promise of profit or other financial return;
  • placing, selling or purchasing securities;
  • providing or obtaining loans and credit;
  • creating investment schemes;
  • raising funds in exchange for participation in the capital of commercial organizations;
  • conducting other regulated investment activities.

1.5. Financial support provided to projects on OM2OM does not give a participant an equity interest in a project, ownership of a business, a right to profit, interest or any other investment return.

3. Registration and user account

3.1. To use certain OM2OM functions, the user must register and create a personal account.

3.2. The user must provide accurate, current and complete information.

3.3. The user is responsible for safeguarding their account access credentials and for actions performed through their account.

3.4. The user must immediately notify OM2OM if unauthorized access to the account is suspected.

3.5. Projects may be independently created by fully legally capable persons aged 18 or older, as well as by legal entities and organizations acting through duly authorized representatives.

4. Types of projects

OM2OM allows projects aimed both at obtaining support and at offering help to other people.

4.1. Financial help

Projects intended to raise funds for a specific idea, initiative or stated result.

4.2. Material help

Projects requiring goods, equipment, materials, products or other material resources.

4.3. Hands-on support

Projects requiring people willing to contribute time, knowledge, professional skills, work or direct participation.

4.4. Offer help

In the “Offer help” section, individuals, companies and organizations may themselves publish offers of help to other people.

Help may be:

  • material — provision of goods, products, materials, equipment and other resources;
  • hands-on — provision of time, work, professional knowledge, consultations, services, volunteering or other practical support.

The author independently determines the scope of help, conditions, timeframes, possible categories of recipients and, where necessary, the criteria for selecting them.

Financial help is not provided in the “Offer help” section.

4.5. If the same initiative requires different forms of support, the author may create separate projects of the relevant types.

5. Creating a project

5.1. The author independently determines the idea and purpose of the project.

5.2. When creating a project, the author must provide sufficient information enabling users to understand:

  • what the project idea is;
  • what its specific purpose is;
  • why the project is important;
  • what result is expected to be achieved;
  • what resources are required;
  • how the support received is intended to be used;
  • within what timeframe the project is expected to be implemented.

5.3. For financial-help projects, the author states the required amount, selects the available funding model and provides the banking and other information required to receive funds.

5.3.1. The author may select “Standard funding” or, if appropriate to the nature of the project and approved by OM2OM, the “Every amount raised matters” model.

5.3.2. When selecting the “Every amount raised matters” model, the author must explain how the funds will be used if the financial goal is not reached in full.

5.3.3. OM2OM may refuse to apply this model if the project result cannot objectively be achieved in part or if the use of a partial amount would not correspond to the stated purpose.

5.4. The author is responsible for the accuracy of the information, documents, photographs, videos and other materials they publish.

6. Project moderation

6.1. Every project is subject to OM2OM moderation before publication.

6.2. Moderation is intended to verify the project's compliance with these Terms and the platform's general requirements.

6.3. OM2OM may request additional information, documents, confirmations or changes to the project description from the author.

6.4. OM2OM may refuse to publish a project if the information provided is insufficient, gives rise to reasonable doubts or the project does not comply with these Terms.

6.5. Passing moderation does not mean that OM2OM guarantees the accuracy of all statements made by the author, achievement of the project result or fulfillment by the author of all their obligations.

7. Eligible projects

A project may be published if:

  • the author is entitled to create and implement such a project;
  • the project has a clear idea and a specific purpose;
  • the author has explained why the project is important and what result is expected to be achieved;
  • the necessary resources and timeframes are specified, where applicable;
  • sufficient and accurate information is provided;
  • the project complies with the laws of the Republic of Moldova and these Terms;
  • the necessary payment and banking information is provided for a financial project.

8. Prohibited projects

OM2OM does not publish projects:

  • created by persons who lack the necessary legal capacity or authority;
  • whose purpose consists exclusively of personal purchases or personal consumption without a clear project or result;
  • primarily aimed at repaying personal debts, loans or mortgages;
  • related to political campaigning, financing political parties, candidates or political campaigns;
  • aimed at promoting religious activities or raising funds for religious campaigning;
  • related to investments, loans, securities or promises of financial return;
  • that violate the laws of the Republic of Moldova;
  • that violate the rights and legitimate interests of third parties;
  • that infringe intellectual-property rights;
  • that contain knowingly false or misleading information;
  • that promote violence, hatred, discrimination, terrorism or criminal activity;
  • that may create an unjustified risk to people's life, health or property;
  • whose purpose or intended use of the support received cannot be clearly explained.

8.1. OM2OM does not publish medical projects, including fundraising for the treatment, diagnosis, medical procedures, surgery, medicines, medical rehabilitation or other medical expenses of a specific individual.

8.2. This restriction does not mean an automatic prohibition on social, educational, infrastructure or other non-medical initiatives of organizations operating in the health sector, provided that the purpose of the project is not to finance the medical expenses of a specific individual. The decision is made by OM2OM during moderation.

9. Project publication

9.1. After successfully passing moderation, the project may be published on the platform.

9.2. From the moment of publication, information about the project becomes available to OM2OM users and, if the relevant page is public, to other website visitors.

9.3. The author may distribute the project link through websites, social networks, messaging services, media and other lawful channels.

9.4. Material changes to the purpose, conditions, required amount or resources of the project may require renewed moderation.

9.5. Certain project functions may be temporarily restricted during renewed moderation.

10. Supporting projects

10.1. The user independently decides whether to support a particular project.

10.2. Before providing support, the user should review the project description and the available information about the author and project conditions.

10.3. OM2OM does not compel users to support projects and does not guarantee achievement of the project's stated purpose.

10.4. Support may be provided only through the methods made available by the functionality of the relevant project.

11. Financial help

11.1. Projects in the “Financial help” category are intended for non-repayable support of specific ideas, projects and initiatives.

11.2. The user independently determines which project they wish to support and in what amount.

11.3. Financial help is voluntary and does not grant the project participant:

  • an equity interest in a project, company or organization;
  • ownership of the project or its assets;
  • a right to receive profit;
  • interest or other financial return;
  • securities or other financial instruments;
  • a right to demand repayment of the funds provided, except in cases expressly provided by law, these Terms or the conditions of the specific project.

11.4. Financial help is not a loan, credit, investment, capital contribution or acquisition of a financial instrument.

11.5. OM2OM does not promise or guarantee that a participant will receive a financial or other property benefit in exchange for supporting a project.

11.6. Before making a payment, the user is given the opportunity to review the main information about the project, its author, the stated purpose and the required amount.

11.7. Payments are made using the payment methods available on the platform and may be processed by banks, payment organizations and other authorized payment service providers.

11.8. OM2OM does not store the user's full bank-card details where those details are entered and processed directly by the payment service provider.

11.9. The project author must use the funds received exclusively to achieve the stated purpose of the project or for related expenses reasonably necessary for implementation of the project.

11.10. If, after publication of the project, circumstances arise that materially affect the possibility of achieving the stated purpose or the use of the funds received, the author must inform OM2OM and the project participants.

11.11. The author is independently responsible for tax, accounting, licensing and other obligations arising in connection with the receipt and use of funds, unless otherwise provided by law.

12. Material help

12.1. A participant may provide the project author with goods, materials, equipment, products or other resources specified in the project.

12.2. The procedure for transfer, delivery, receipt and use of material help is determined by the conditions of the specific project and arrangements between the participants.

12.3. If OM2OM does not directly participate in receiving, storing or delivering property, the platform is not responsible for its transfer between users.

13. Hands-on support

13.1. A user may join a project by contributing their time, knowledge, professional skills, work or other voluntary activity.

13.2. The specific conditions of participation are agreed between the project author and the participant.

13.3. Unless expressly stated otherwise, participation in such a project is voluntary and does not create an employment relationship between the participant, the project author and FUNDATIA OM2OM.

14. Rewards

14.1. The author may provide one or more rewards for participants or may provide no rewards at all.

14.2. A reward is a form of appreciation for support and does not constitute an investment, interest, dividend or promise of financial return.

14.3. Rewards may be provided in ordinary financial-help, material-help and hands-on-support projects where this is appropriate to the nature of the project and supported by the platform functionality. Rewards are not provided in projects in the “Offer help” section.

14.4. The author independently determines the type and description of the reward, the required amount or type of support, quantity, availability date, method of receipt, delivery conditions and cost, as well as other material conditions.

14.5. When selecting a reward, the user provides the information required to receive it, including, where applicable, name, contact details, delivery address, size and other characteristics.

14.6. Information about the selected reward is displayed in the personal account. OM2OM may also send notifications by e-mail or another available method.

14.7. Unless the project conditions provide otherwise, rewards are provided or dispatched after successful completion of the project and after the availability date stated by the author has occurred.

14.8. The author is independently responsible for the production, availability, quality, conformity with the description, timing, transfer and delivery of rewards.

14.9. OM2OM provides the technical ability to publish information about rewards but is not their seller, manufacturer or supplier unless expressly stated otherwise.

14.10. Permitted rewards may include goods, souvenirs and promotional merchandise, products or results of the project, acknowledgements and mentions, meetings, consultations, tours, participation in the implementation process, access to materials or content, and other lawful forms of appreciation.

14.11. Cash payments as returns, interest, profit, dividends, investment instruments, goods and services prohibited by law, alcoholic beverages and tobacco products, as well as goods or services for which the author lacks the required permits or licences, are prohibited as rewards.

15. Project author's obligations

The project author must:

  • provide accurate information;
  • use the support received in accordance with the stated purpose;
  • inform participants in a timely manner about material changes to the project;
  • not mislead users;
  • comply with the laws of the Republic of Moldova;
  • respect the rights of third parties;
  • provide OM2OM with requested documents and confirmations where such a request is justified for the purposes of moderation, security, settlements or compliance with law;
  • publish the reporting required by these Terms.

16. Project reporting

16.1. After receiving support, the author must inform participants about the progress of project implementation and the use of the resources received.

16.2. The project author must publish a final report on implementation of the project and use of the support received no later than 30 days after the project ends, unless OM2OM sets a different deadline for the specific project.

16.3. Depending on the nature of the project, OM2OM may request additional or interim reporting.

16.4. The report may include text, photographs, documents, information about expenses, resources received, work performed, results achieved and other information enabling participants to understand how the support provided was used.

16.5. If mandatory reporting is not provided, OM2OM may request explanations from the author, restrict the ability to create new projects, temporarily block the account or indicate in the profile that the author has failed to fulfil their obligations.

17. Rights of project participants

A participant has the right:

  • to access project information available on the platform;
  • to independently choose the projects they wish to support;
  • to receive updates and reports published by the author;
  • to contact OM2OM with questions about the operation of the platform;
  • to report suspected violations of these Terms.

18. Project suspension and termination

18.1. OM2OM may temporarily suspend or permanently terminate publication of a project if:

  • false or misleading information has been identified;
  • the author violates these Terms;
  • there are grounds to believe that the project violates the law;
  • a substantiated complaint concerning infringement of third-party rights has been received;
  • the author fails to provide requested documents or explanations;
  • continued implementation of the project has become impossible;
  • continuation of the project may cause significant harm to users or third parties;
  • this is required by a competent public authority or by the laws of the Republic of Moldova.

18.2. Where possible, OM2OM informs the author of the reason for restricting or terminating the project.

19. Financial settlements, project success and fees

19.1. For a financial project, the author sets the financial goal and selects the applicable funding model before publication.

19.2. Under the “Standard funding” model:

  • less than 50% of the goal — the project is unsuccessful, funds are not transferred to the author, no fee is charged, and the funds are returned to participants' wallets;
  • from 50% to 99.9% — fundraising is successfully completed; the total fee charged by OM2OM and payment aggregators is 15% of the amount actually raised;
  • 100% or more — the goal is reached or exceeded; the total fee is 10%.

19.3. Under the “Every amount raised matters” model, no minimum threshold applies. The author receives the funds actually raised regardless of the percentage of the goal achieved, and the total fee charged by OM2OM and payment aggregators is 10%.

19.4. This model applies only if it was specified before publication and approved by OM2OM during moderation. Information about the model must be clearly displayed on the project page before financial support is provided.

19.5. For financial projects in the “Charity” category, the total fee charged by OM2OM and payment aggregators is 5.9% of the amount actually raised where the project is successfully completed under the selected model.

19.6. If a charity project uses the standard model and raises less than 50%, it is unsuccessful, no fee is charged, and the funds are returned to participants. If the “Every amount raised matters” model was approved, no minimum threshold applies and the fee is 5.9%.

19.7. OM2OM does not charge a project-creation fee for “Material help”, “Hands-on support” or projects in the “Offer help” section.

19.8. Fees do not include taxes or other mandatory payments payable by the author.

19.9. The author independently determines and fulfils their tax, accounting and other obligations unless otherwise provided by law.

19.10. The financial conditions, funding model and applicable fee must be available to the author before publication of the project.

19.11. OM2OM does not finance the difference between the amount actually raised and the stated goal.

19.12. Before transferring funds, OM2OM may carry out an additional verification of the author, banking details, project documents, purpose of payments and other necessary information.

19.13. OM2OM may temporarily suspend transfer of funds where there are reasonable suspicions of fraud, violation of law or these Terms, use of funds inconsistent with the stated purpose, or where verification by a bank, payment organization or public authority is required.

20. Unsuccessful project, cancellation and refunds

20.1. If a financial project using the standard model has raised less than 50% of its goal by the end of the fundraising period, it is considered unsuccessful, the funds are not transferred to the author and are returned to the participants.

20.2. This rule does not apply to projects for which the “Every amount raised matters” model was approved and disclosed in advance.

20.3. Funds subject to refund are credited to the user's wallet in their OM2OM personal account.

20.4. After the funds are credited, OM2OM informs the user through the personal account, by e-mail or another available method.

20.5. The user may direct all or part of the funds to another project, keep them in the wallet for later use or request their withdrawal.

20.6. A withdrawal request is submitted through the “Wallet” section. OM2OM may request information necessary to identify the user, verify the payment and comply with the law.

20.7. If submitting a request through the account is technically impossible, the user may contact support@om2om.md.

20.8. After the request is confirmed, OM2OM initiates the withdrawal within up to 10 business days, unless a different period is determined by law, bank or payment-organization requirements, additional verification or the circumstances of the transaction.

20.9. The actual time required to receive the funds also depends on the bank, payment system and payment method.

20.10. Withdrawal is made using a method available within the payment infrastructure in use. Where required by law, provider rules or anti-fraud measures, OM2OM may require withdrawal to a payment instrument or bank account associated with the original transaction or belonging to the user.

20.11. If a participant selected a reward and the project is deemed unsuccessful and the reward will not be provided, the corresponding financial support is returned to the user's wallet.

20.12. A user's change of mind after successful completion of fundraising and transfer or provision of the funds to the author does not, in itself, constitute grounds for a refund unless otherwise provided by law or the project conditions.

20.13. If funds have already been transferred to the author but the project has been terminated or material violations have been identified, the issue of refunds is considered taking into account the use of the funds, the author's obligations, the nature of the violation and the requirements of law.

20.14. In cases of knowingly false information, misuse of funds or other unlawful actions, OM2OM may suspend the project and payments, block the account, request documents and reports, demand repayment where provided by law or agreement, and contact the competent authorities.

21. No investment character

21.1. Through the functionality described in these Terms, OM2OM does not provide services for raising investments or arranging loans between investors, creditors, entrepreneurs and borrowers.

21.2. A user who provides financial help to a project acts as a participant providing non-repayable support to the relevant initiative, not as an investor or creditor.

21.3. Authors are prohibited from using OM2OM to offer users:

  • interest on funds provided;
  • repayment of funds with profit;
  • an equity interest in a commercial organization;
  • dividends;
  • securities;
  • tokens or other instruments carrying financial rights;
  • any other form of investment return.

21.4. Projects that in substance exhibit characteristics of investment, lending or other regulated financial activity may be rejected or removed by OM2OM regardless of the name used by the author for the project.

22. Verification of authors and projects

22.1. For user safety, fraud prevention and compliance with law, OM2OM may verify project authors.

22.2. Depending on the nature of the project, OM2OM may request:

  • an identity document;
  • documents of a legal entity or organization;
  • proof of the representative's authority;
  • banking details;
  • documents confirming the circumstances described in the project;
  • estimates, invoices, supplier quotations or other evidence of expected expenses;
  • information about the ultimate beneficiary of the support;
  • other information objectively necessary to verify the project.

22.3. A request for documents does not mean that OM2OM assumes responsibility for the project or guarantees the accuracy of all information provided by the author.

22.4. OM2OM may refuse publication or suspend the project if the author refuses to provide information reasonably necessary for verification.

23. Project author's responsibility

23.1. The author is independently responsible for the project content, accuracy of information, legality of the project and use of the support received.

23.2. The author is responsible for fulfilling the obligations stated to participants.

23.3. If the author has misused the money or resources received or knowingly provided false information, OM2OM may restrict the author's account, terminate the project and take other actions provided by law and these Terms.

24. OM2OM's role and responsibility

24.1. OM2OM provides infrastructure for interaction between project authors and participants.

24.2. Unless expressly stated otherwise, OM2OM is not the project performer and does not assume the author's obligations to achieve the stated result.

24.3. Project moderation is not a guarantee of success, quality, economic viability or achievement of the stated result.

24.4. OM2OM takes reasonable measures to ensure operation and security of the platform but does not guarantee absolutely uninterrupted operation of the website.

25. Intellectual property

25.1. A user may publish only materials for which they have the necessary rights of use.

25.2. By publishing project materials on OM2OM, the author grants FUNDATIA OM2OM a non-exclusive right to use them to the extent necessary for publication, operation, informational support and promotion of the relevant project and the platform.

25.3. The author retains their intellectual-property rights in materials created by them.

26. Personal data

26.1. Users' personal data is processed in accordance with the laws of the Republic of Moldova and OM2OM's “Privacy & Cookies” document.

26.2. The user should review that document before providing personal data to the platform.

26.3. A project author who receives participants' personal data through the platform may use it only for lawful purposes directly related to the relevant project and must ensure its appropriate protection.

27. Prohibited user conduct

When using OM2OM, users are prohibited from:

  • knowingly providing false information;
  • impersonating another person;
  • using the platform for fraud;
  • violating the rights of other users;
  • publishing malicious software code;
  • attempting to gain unauthorized access to platform accounts, servers or data;
  • using automated means to disrupt the normal operation of the website;
  • using other users' personal data for purposes other than those for which it was provided;
  • using OM2OM for activities prohibited by the laws of the Republic of Moldova.

28. Account restriction and blocking

28.1. OM2OM may temporarily restrict or block a user's account in the event of a violation of these Terms, suspected fraud, a threat to the security of the platform or other users, or in cases provided by law.

28.2. Depending on the nature of the violation, OM2OM may request explanations or additional documents from the user.

28.3. Material or repeated violations may result in permanent blocking of the account.

29. Good faith and participant trust

29.1. OM2OM is based on the principle of voluntary interaction between people who care about particular ideas, initiatives and results.

29.2. Users undertake to use the platform in good faith and not to exploit the trust of other participants to obtain an unjustified personal benefit.

29.3. The project author must make efforts to achieve the stated purpose and openly inform participants about material circumstances affecting the project.

29.4. Failure to achieve the stated result is not, in itself, considered a violation of these Terms if the author acted in good faith, used the support received in accordance with the stated purpose and provided participants with accurate reporting.

29.5. Concealment of material information, deliberate deception of participants, fictitious projects, forged documents and intentional misuse of the support received are considered material violations of these Terms.

30. Complaints and violation reports

If a user believes that a project, another user or information published on the platform violates these Terms or the law, they may notify OM2OM at:

office@om2om.md

OM2OM may request additional information necessary to review the report.

31. Changes to these Terms

31.1. FUNDATIA OM2OM may amend these Terms in connection with development of the platform, changes to its functionality, legislation or service conditions.

31.2. The current version of the Terms is published on OM2OM.MD and states the date of the latest update.

31.3. Material changes apply from the time specified in the new version of the Terms unless otherwise provided by law.

32. Applicable law and dispute resolution

32.1. These Terms are governed by the laws of the Republic of Moldova.

32.2. The user and FUNDATIA OM2OM seek to resolve any disputes through negotiations and the exchange of written communications.

32.3. If a dispute cannot be resolved in this manner, it is resolved by the competent authorities or courts of the Republic of Moldova in accordance with applicable law.

33. Final provisions

33.1. If any individual provision of these Terms is declared invalid or unenforceable, this does not affect the validity of the remaining provisions.

33.2. Matters not governed by these Terms are governed by the laws of the Republic of Moldova and, where necessary, by separate agreements between FUNDATIA OM2OM and the relevant user or project author.

33.3. Applicable platform policies and documents, including the “Privacy & Cookies” document, form an integral part of the OM2OM terms of use framework.
